(In these terms and conditions, the words ‘we’, ‘us’ and ‘our’ are used in reference to Heartisan Fine Foods only).

1. Heartisan Fine Foods – who we are and how to contact us
1.1 Heartisan Fine Foods is a trading division of Cadman Fine Wines Ltd (Company No. 4231959). The registered and trading office is 6 The Woodyard, Castle Ashby, Northampton, NN7 1LF. 2. Minimum Order
There is no minimum order.

3. Prices And Payment
3.1 All prices are quoted in Pounds Sterling, inclusive of VAT at the prevailing rate, unless otherwise specifically stated. Delivery charges are additional, where appropriate (see Clause 4 below). If you would like a VAT invoice please indicate this at the time of ordering.
3.2 We accept payment by Maestro, Visa, MasterCard, American Express and PayPal.
3.3 Any discounts offered are based on prices that have been previously advertised on our website or in monthly mailings. Discounted products will have been available at their previously advertised price for at least 28 consecutive days in the previous 6 months.

4. Delivery & Insurance
4.1 Orders will be delivered to any single UK address. Orders will attract a delivery charge of £2.99 (inc. VAT) per single UK mainland address. You agree that we may use independent third parties to deliver the products.
4.2 We can deliver to and accept orders from the Channel Islands and overseas. Please contact us for the current relevant charges that maybe applicable. Any duty incurred shipping internationally is the responsibility of the customer.
4.3 We aim to deliver within five working days or less to UK mainland (non-mainland UK and overseas delivery will take longer). However, we are grateful for your understanding that in exceptional circumstances beyond our control delivery may take longer. While every effort is made to despatch your orders within a few days of acceptance, please allow up to 30 days for delivery. In such cases, we will attempt to notify you and Heartisan Fine Foods reserves the right to despatch the order within a reasonable period of the occurrence of such delay.

5. Substitutions
We cannot guarantee the availability of all the products we advertise. In the event that a product becomes unavailable we will contact to advise a suitable replacement.

6. Cooling Off Period And Customer Guarantee
6.1 You are entitled to cancel your order, by contacting Heartisan Fine Foods using the contact details provided at the beginning of this document, for a period of 14 working days from delivery to you.
6.2 The additional customer guarantee provided in Clause 6.1 above is intended for the benefit of all our customers. However, if we believe that a customer has abused this guarantee, we may decide to withdraw the benefit of the customer guarantee from that customer. Alternatively, we reserve the right to close that or any other account of the Customer without notice and/or refuse to accept any further orders from that customer. In these circumstances, our decision will be final.

7. Refunds
Refunds for returned products will be organised immediately on receipt of the products at our warehouse, providing they remain in saleable condition. Returned products which are deemed not to be saleable cannot be refunded and will result in redelivery. We will process the refund within 14 calendar days of receiving the products back.
Please be aware that any refunds to a credit card will be processed immediately by us but may take between 3 – 10 days to appear on your statement. However, we reserve the right to deduct from the amount refunded the cost of returning the products to Heartisan Fine Foods.

8. Vouchers
8.1 Should you receive a voucher to redeem against the purchase of products from us, you agree to be bound to the terms and conditions on that voucher.
8.2 Vouchers are not transferable and may not be sold or auctioned.

9. Force Majeure
9.1 The company will not be liable for failure to meet agreed obligations due to prevailing circumstances beyond our reasonable control.

10. Clearance Sales
10.1 In the case of clearance sales, items are offered at no further discount.
10.2 You are entitled to cancel your order, by contacting Heartisan Fine Foods using the contact details provided in Clause 1 above, for a period of 14 working days from delivery to you. After this period has expired, we cannot accept returns of clearance sale items, other than in instances where the product is actually faulty (i.e.: broken). On this occasion the additional customer guarantee provided in Clause 6.1 above does not apply, however this does not affect your statutory rights.

11. Data Protection and Privacy Policy
11.1 Heartisan Fine Foods is committed to preserving the privacy of all visitors to its website. By registering, visiting or placing an order with Heartisan Fine Foods, you consent to the collection, holding, use and transfer of certain information about yourself and your usage of (and communications with) this website and our telephone ordering system, in accordance with these terms and conditions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.
11.2 Your information will enable us to provide you with access to our site, to supply the goods you have requested and inform you of promotions and special offers. It will also enable us to bill you and contact you where necessary concerning your orders. We will also use and analyse the information we collect so that we can administer, support, improve and develop our business. In particular, we may use your information to contact you for your views on our services and to notify you occasionally about important changes or developments to the site or our services. Further, where you have consented, we might also use your information to let you know about other products and services which we offer which may be of interest to you and we may contact you by post, telephone or fax, as well as by e-mail. If our business enters into a joint venture with or is sold to or merged with another business entity, your information may be disclosed to our new business partners or owners. If you change your mind about being contacted in the future, please let us know by contacting the Customer Services department, the details can be found in clause 1 of the terms and conditions.
11.3 Where you have consented when providing us with your details, we may also allow carefully selected third parties, including other companies in our group, to contact you occasionally about products and services which we think may be of interest to you and which may be the subject of direct marketing. They may contact you by post, telephone or fax, as well as by e-mail. If you do not wish us to do so please tick the appropriate box on the registration page. If you change your mind about being contacted by these companies in the future, please let us know. We will however always send an email confirming an order placed on the web site in line with Electronic Commerce Regulations 2002. Unless required to do so by law, we will not otherwise share, sell or distribute any of the information you provide to us without your consent.
11.4 Cookies are small amounts of information, which we store on your computer. Unless you have indicated your objection when disclosing your details to us, our system will issue cookies to your computer when you log on to the site. Cookies make it easier for you to log on to and use the site during future visits. They also allow us to monitor website traffic and to personalise the content of the site for you. You may set up your computer to reject cookies although, in that case, you may not be able to use certain features on our site.
11.5 We employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period or as long as the law requires.
11.6 You are entitled to see the information held about you and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. If you wish to do this, please contact us. We are entitled by law to charge a fee of £10 to meet our costs in providing you with details of the information we hold about you.
11.7 Any changes to the privacy policy, contained in this Clause 12, will be posted to the site and, where appropriate, through e-mail notification.
11.8 All comments, queries and requests relating to our use of your information are welcomed and should be addressed to the contacts detailed in Clause 1 above.

12. Warranty; Limitation on Liability
12.1 We warrant that the products will be of satisfactory quality and fit for their general purpose, but make no other warranty with respect to the products except as required by law and as set out in Clause 6 and Clause 9.
12.2 Nothing in these terms and conditions shall exclude our liability for personal injury or death caused by our negligence.
12.3 We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where such loss or damage: “was not foreseeable to both us and you when the contract was formed”; was not caused by any breach on our part”; and/or “relates to business and/or non-consumers”.
12.4 Subject to Clause 12.2 above we will not be liable for loss or damage caused by your handling the products. In particular we will not be liable for spillages or breakages.

13. Changes to these terms and conditions
13.1 We may amend these terms and conditions from time to time without notice.

14. Governing Law and Jurisdiction and codes of conduct
14.1 These terms and conditions and the relationship between Heartisan Fine Foods and you shall be governed by and construed in accordance with the laws of England and Wales and you irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales over any claim or matter arising under or in connection with these terms and conditions or the legal relationship established between you and Heartisan Fine Foods.
14.2 There are no codes of conduct applicable to any contract between Heartisan Fine Foods and you.
